CITY OF BUFFALO

AN INTERIM ORDINANCE ESTABLISHING A MORATORIUM ON THE SALE AND MANUFACTURE OF HEMP DERIVED THC (TETRAHYDRO-CANNABINOLS) FOOD AND BEVERAGES IN THE CITY OF BUFFALO, MINNESOTA

WHEREAS, pursuant to Minnesota Statutes, Section 462.355 subdivision 4, many cities have adopted interim ordinances in order to study the impacts of certain uses and determine whether regulations are appropriate for the purpose of protecting the public health, safety and welfare of their citizens; and

WHEREAS, the sale and manufacture of THC products does implicate public health, safety and welfare in regards to ensuring such products comply with state law, are not marketed and readily available to persons under age 21, and are located within suitably zoned areas in the City.

WHEREAS, the City is undertaking a study to consider possible changes to the Zoning Ordinance and City Code that would consider licensing, rules and regulations and sales management controls for the sale and manufacturing of food and beverage products that contain THC, whether for medical, recreational or for other human consumption purposes and may implement many of the suggestions from the study.

NOW, THEREFORE, the City Council of Buffalo does ordain:

SECTION 1.  No business, person or entity may sell or manufacture in any way, whether medical or recreational, any food and beverage products that contain THC extracted from hemp in any form, for a period of up to twelve (12) months from the effective date of this ordinance or until ordinances regulating such uses become effective or until the Council rescinds this Interim Ordinance, whichever occurs first.

SECTION 2. City Staff is directed to conduct a study to gather information and make a recommendation to the Council to determine if the Zoning Ordinance and City Code need to be amended regarding these types of uses to better protect the citizens of Buffalo, and if so, what regulations are appropriate.

This Amendment shall become effective upon publication.
